Supreme Court suspends agricultural laws, forms committee over farmers’ objections

The Supreme Court on Tuesday suspended the implementation of three controversial agricultural laws, calling its order a “victory of fair play”.

 “The Law on Trade in Agricultural Products and Trade (Promotion and Facilitation), the Law of the Agreement for Guarantee of Agricultural Prices and Services (Empowerment and Protection) of Farmers and the Law on Essential Products (Amendment) will be suspended until further notice “

Chief Justice Bobde said at the end of a one-hour virtual hearing.
  • The suspension of its implementation means that the Center cannot, for the moment, take any executive action based on the three laws.
  • The court formed an expert committee to hear arrests raised by farmers against the laws. The committee is made up of Bhupinder Singh Mann, agricultural economist Ashok Gulati, Dr Pramod Kumar Joshi (former director of the National Academy of Agricultural Research Management) and Anil Ghanwat of Shetkari Sangathan.
  • The committee will report to the tribunal. Interestingly, all of the panel members have a history of supporting farm laws, a fact that sparked outrage among restless farmers.
  • In forming the committee, the tribunal was not intimidated by statements released Monday by some farmer organizations refusing to cooperate with its committee.
  • Farmer unions protesting the new agricultural marketing laws on Tuesday disapproved of the Supreme Court-appointed committee and said they will not appear before the panel.
  • At a press conference at the Singhu border near Delhi, union leaders said members of the committee formed by the High Court were “pro-government”.

CJI does not support resuming physical hearings

Indian Chief Justice Sharad A. Bobde disagreed Tuesday with resuming physical hearings at the Supreme Court, saying the court did not want to be the cause of death from the spread of the coronavirus.

  • The bench of three was listening to a suo motu case seeking financial aid for young lawyers struggling to make ends meet during the pandemic.
  • One of the lawyers had requested a physical hearing in the case. During the hearing, senior lawyer PS Narasimha, as a senior member of the Bar Association, said Bar Councils are ready to guarantee government loans of up to Rs. 3 lakh for them, young lawyers in difficulty.
  • But the chief justice said the Law Society and wealthy lawyers should contribute more than they already have. Ways should be found to channel bar funds.

Industrial production contracted 1.9% in November, entering negative territory after a gap of two months, mainly due to the poor performance of the manufacturing and mining sectors, official data showed on Tuesday. The manufacturing sector, which constitutes 77.63% of the industrial production index (IIP), registered a contraction of 1.7% in November 2020, according to data published by the National Statistics Office.

The Tamil Nadu government announced Tuesday that the general public will not be able to enter state beaches and some tourist spots in Chengalpattu district between January 15 and 17. Apart from the beaches, including the marina in the state capital, the public would not be allowed to enter the Vandalur Zoo and the Mamallapuram tourist spots, as well as Guindy National Park during those three days. This decision is part of the precautionary measures taken to stop the spread of Covid-19 during the Pongal season, when more steps are expected in these places.
