DNA bill could be misused for caste-based profiling, says parliamentary group’s draft report

The DNA Technology Regulation (Use and Enforcement) Act 2019 has been under development for 15 years. It offers DNA sampling and profiling of citizens accused of crimes and offers to store their unique genetic information for administrative purposes.

  • But the bill contains alarming provisions that could be misused for caste or community profiling, according to a draft report by the parliamentary standing committee on science and technology.
  • The committee, chaired by Congress leader Jairam Ramesh, met on Monday, but lacking a quorum meant the draft report, which was distributed to committee members, was not finalized.
  • The committee, in its preliminary report, noted that DNA profiles can reveal extremely sensitive information about an individual, including ancestry, skin color, behavior, illnesses, health status and vulnerability to diseases.

“Under the provisions of the bill, access to such intrusive information can be misused to specifically target individuals and their families with their own DNA data. This is of particular concern as it could even be used to improperly link a particular caste / community to criminal activity, ”

the report notes.
  • The report also highlighted disregard for an individual’s privacy and other safeguards.

SC will look into the “effect” of Bhushan’s additional statement tomorrow

Prominent human rights lawyer Prashant Bhushan told the Supreme Court today that apologizing for his insincere tweets, which were the expression of his true convictions, would amount to “contempt of my conscience and of an institution which I hold in the highest esteem”.

  • In an additional affidavit filed on Monday, Bhushan told the court: “My tweets represented this sincere belief that I continue to have.
  • The public expression of these beliefs was, I believe, consistent with my highest obligations as a citizen and a loyal official of this court.
  • Therefore, an apology for the expression of these beliefs, conditional or unconditional, would not be sincere.”
  • A three-judge bench led by Judge Arun Mishra had given Bhushan until August 24 to issue an unconditional apology. The SC will examine the “effect” of Bhushan’s supplementary statement tomorrow.
  • In an earlier statement, read to court during the contempt hearing on August 20, Bhushan refused to apologize for his tweet about Chief Justice SA Bobde on a heavy bike and another about the role of the Supreme Court over the past six years.
  • He had quoted Mahatma Gandhi as saying that he asked for neither mercy nor magnanimity and that he would gladly accept any punishment the court deemed appropriate.

Vijayan government could face a motion of no confidence

Harassed by corruption allegations and aware of polls by local bodies in November, Kerala Chief Minister Pinarayi Vijayan braced himself to face the first motion of no confidence against his four-year government in the Legislative Assembly. Consider keeping NEET online from next year, SC tells MCI

  • He was addressing MCI counsel Gaurav Sharma during the virtual court hearing. The court, however, refused to order the authorities to set up exam centres abroad or have the NEET held online this year to facilitate candidates abroad. The NEET is fixed for September 13.
