Supreme Court rejects Aadhaar’s requests for review

  • In the second, he concluded that the Aadhaar law was rightly called the money law. Judge Chandrachud, who was on the bench, dissociated himself from the second finding in 2018.
  • Two years later, again stating his dissent on January 11, Judge Chandrachud disagreed with the other four judges in the bench headed by Judge A.M. Khanwilkar.
  • This time, he said another five-judge tribunal in a separate case, Rojer Mathew v. South Indian Bank Ltd., in November 2019 challenged the Aadhaar tribunal’s findings and sent the case back to court. of seven judges. judges for an authorized catch.
  • He said the Court of Review should wait until the court of seven, which has not yet been constituted, takes an appeal.
  • Requests for review should be kept pending at this time. Dismissing Aadhaar’s review even before the bench of seven judges had a chance to apply their wits and deliver a verdict would amount to “judicial indiscipline” and have “negative consequences,” the judge Chandrachud noted in his dissent.
  • However, the majority of the review bank refused to concede and rejected the grounds for the review, arguing that “a change in law or a subsequent decision / decision of a coordinated or larger bank cannot be considered its own”.
  • In addition to Judges Kahnwilkar and Chandrachud, the other judges on the bar were Judges Ashok Bhushan, S. Abdul Nazeer and B.R. Gavai. The review petitions, mainly from Rajya Sabha member Jairam Ramesh, had highlighted how the Aadhaar law was passed as a money bill replacing the Rajya Sabha. He had called it a “fraud against the Constitution”.
