PM-CARES funds do not need to be credited to NDRF-SC

Supreme Court today ruled that money received in PM-CARES fund does not need to be credited to National Fund Disaster Assistance Response (NDRF) to combat the Covid19 pandemic. A three-judge bench led by Judge Ashok Bhushan said that “PM-CARES is completely different from the NDRF”.

  • On the other hand, the court ruled that “there is no legal prohibition for individuals to make voluntary contributions to the NDRF” under section 46 (1) (b) of the 2005 law on disaster management. Judge Bhushan, found no reason to change the national disaster management plan. “The plan is sufficient,” Judge Bhushan said. There was no need for a new plan in light of the Covid-19 experience.
  • The decision was in response to a PIL filed by the Center for Public Interest Litigation (CPIL), represented by lead counsel Dushyant Dave and attorney Prashant Bhushan.
  • The government considered PM-CARES to be a “public charitable trust” to which “anyone can contribute”. It is a “misconception” that contributions received by a public trust like PM-CARES can be transferred to a legal fund like the NDRF, something the government confirmed in the Supreme Court.
